1. Acceptance of Terms
By accessing or using HAUL PICK (haulpick.com), including the public quote request form and guest dispatch links sent by email, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, do not use the platform.
2. Platform Relationship
HAUL PICK is a technology provider and online marketplace that connects shippers with independent motor carriers and transportation brokers. HAUL PICK does not act as a freight broker, motor carrier, shipper, or logistics provider. We do not take possession of cargo, negotiate freight rates on our own behalf, issue bills of lading, or assume liability for the transportation of goods. All transport contracts, rates, insurance obligations, and liability arrangements are solely between the posting shipper and the booking carrier or broker.
3. Eligibility and Account Types
Company accounts (carriers, brokers, dealers, and auctions) must be created by a legally authorized representative of the business. Carriers must maintain active operating authority and valid insurance at all times. Individuals who are not registered businesses may request a quote through our public quote form and may manage the resulting shipment through secure email links without creating an account.
4. Account Registration and Verification
You agree to provide accurate, current and complete information during registration, including company name, address, phone, website (if any), and the first and last name of the account representative. Company accounts submitting a USDOT or MC number are verified against third-party FMCSA registry data. Registry results are provided for informational purposes only; HAUL PICK does not guarantee their accuracy or completeness, and you remain responsible for independently confirming the authority, insurance and fitness of any party you do business with. HAUL PICK may suspend or restrict accounts pending or following verification.
5. Onboarding Fee, Subscriptions and Coupons
Access to the load board for company accounts requires payment of the applicable onboarding fee or subscription plan shown at checkout. Payments are processed by Stripe; HAUL PICK does not store your full card details. Plans grant access for the stated duration and, unless expressly stated otherwise, all fees are non-refundable. Promotional or coupon codes are single-purpose, may be limited in quantity or time, and may be withdrawn or disabled at any time. We may change pricing prospectively; changes will not affect access already purchased.
6. Posting Loads and Quote Requests
Shippers are solely responsible for the accuracy of load details, including origin and destination, dates, cargo type (vehicle, motorcycle, RV/motorhome, bus, heavy truck, boat, trailer, heavy equipment, or other freight), year/make/model where applicable, quantity and type of freight, condition, color, weight, trailer requirement (open, enclosed, lowboy, or any), special instructions, and uploaded photos. You represent that you own or are authorized to arrange transport of the items posted and that uploaded photos and logos do not infringe the rights of others. Estimated distances shown in miles are approximate and are not a substitute for route planning.
7. Requests, Bids, Counteroffers and Dispatch
Carriers may request to haul a posted load at the listed price or submit a different price. Shippers may accept, decline, or counter, and carriers may counter in return. A dispatch is formed only when the shipper accepts and digitally signs the dispatch. Your typed name and electronic acceptance constitute a legally binding electronic signature under the federal E-SIGN Act and Florida law. Once accepted, the carrier is responsible for performing the haul and updating pickup and delivery status; the shipper is responsible for tendering the cargo as described.
8. Payment Terms Between Users
Unless the parties agree otherwise in writing outside the platform, all loads are posted on COD (cash on delivery) terms. HAUL PICK does not process, escrow, guarantee, collect or remit freight payments between shippers and carriers, and is not responsible for nonpayment, chargebacks, or rate disputes. Users are responsible for their own invoicing, tax reporting and compliance obligations.
9. Communications and Notifications
By using HAUL PICK you consent to receive transactional email regarding your account, quote requests, load requests, counteroffers, dispatches, pickup and delivery status, and in-platform messages. Guest dispatch and messaging links sent by email contain a secret token; anyone with the link can act on that shipment, so do not forward those emails to third parties. Links may expire or be revoked.
10. Ratings and Reviews
After a completed dispatch, users may leave a rating and review of their counterparty. Reviews left for an individual shipper are attributed to that individual, not to any company. Reviews must be truthful and based on an actual transaction. We may remove content that is fraudulent, unlawful, defamatory, or abusive. For privacy, individuals viewing a carrier see the carrier's ratings and reviews rather than full authority records.
11. Prohibited Conduct
You may not post fraudulent or duplicate loads, misrepresent authority, identity, or insurance status, solicit users for unrelated purposes, harass other users, scrape or bulk-extract data, or attempt to circumvent platform security, verification, billing or payment controls.
12. Limitation of Liability
HAUL PICK provides the marketplace “as is” and disclaims all warranties to the maximum extent permitted by law. We are not a party to transport contracts and are not liable for cargo loss or damage, delays, missed pickups, nonpayment, or disputes between users. To the extent permitted by law, our total aggregate liability arising out of or relating to the platform will not exceed the fees you paid to HAUL PICK in the twelve months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless HAUL PICK and its officers, employees and agents from any claims, damages, penalties or expenses (including reasonable attorneys' fees) arising from your use of the platform, your loads or shipments, your content, or your violation of these Terms or applicable law.
14. Termination
We may suspend or terminate your account at any time for violations of these Terms, fraudulent activity, nonpayment, or failure to maintain required operating authority or insurance. Administrators may delete accounts and associated marketplace records upon request or for cause.
15. Changes to These Terms
We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute will be brought exclusively in the state or federal courts located in Lee County, Florida.
